HOUSE CONCURRENT

RESOLUTION

 

requesting that the department of human resources development submit a timetable to implement the conversion of exempt employees to civil service as required under section 144 of act 253, session laws of hawaii 2000.

 

 

WHEREAS, pursuant to section 144 of Act 253, Session Laws of Hawaii 2000, the Department of Human Resources Development is required to annually submit to the Legislature a report on all permanent positions exempted from the civil service; and

WHEREAS, section 144 of Act 253, Session Laws of Hawaii 2000, also required the Department of Human Resources Development to report on when these exempt positions were established, the purpose of the positions, the reason for the exemption from civil service, and findings and recommendations on whether the positions should remain exempt or be converted to civil service positions; and

WHEREAS, with respect to positions recommended for inclusion into the civil service, the Department of Human Resources Development was also required to submit proposed legislation to convert exempt positions to civil service positions, and address the impact of the conversion on the incumbents in these positions, if any; and

WHEREAS, since Act 253, Session Laws of Hawaii 2000, was enacted, the Department of Human Resources Development has converted few, if any, exempt positions to civil service; and

WHEREAS, in testimony provided by the Department of Human Resources Development on legislation introduced during the 2006 Regular Session that would have converted certain exempt positions to civil service, the Director of Human Resources Development stated that more time is needed to implement the conversion of exempt positions to civil service as envisioned under Act 253, Session Laws of Hawaii 2000; and

WHEREAS, the Legislature believes that because six years have transpired since the enactment of Act 253, Session Laws of Hawaii 2000, the Department of Human Resources Development should have developed an implementation plan for the conversion of positions from exempt status to civil service; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the Senate concurring, that the Department of Human Resources Development is requested to submit a timetable to the Legislature on implementing the conversion of exempt employees to civil service positions as provided under section 144 of Act 253, Session Laws of Hawaii 2000; and

BE IT FURTHER RESOLVED that the Department of Human Resources Development is requested to submit the timetable and any proposed legislation to the Legislature no later than twenty days prior to the convening of the 2007 Regular Session; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Human Resources Development.
