A BILL FOR AN ACT
relating to public contracts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§103- Security contract, prohibits foreign owned or controlled entities. (a) No agency or department of the State or any of its political subdivisions shall enter into a contract for the provision of security services unless:
(1) The contract is with a guard agency licensed under chapter 463; and
(2) The guard agency is not owned or controlled, directly or indirectly, by a foreign person.
(b) For purposes of this section:
"Business" means any corporation, partnership, individual, sole proprietorship, joint venture, or any other private legal entity.
"Foreign person" means any individual who is not a citizen or lawful permanent resident of the United States or any business that is owned or controlled, directly or indirectly, by a person or persons who are not citizens or lawful permanent resident aliens of the United States.
"Security services" means the provision of services to provide security for public facilities and persons lawfully within the public facilities, to include but not be limited to guarding public facilities, screening persons entering public facilities, or otherwise safekeeping public facilities."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
