A BILL FOR AN ACT

 

RELATING TO HEALTH.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that greater transparency into public health violations by food establishments will increase food safety. A food establishment is more likely to correct deficiencies and violations found during inspections, and correct them faster, if information regarding the deficiencies and violations is readily available to the public.

The legislature further finds that making inspection reports available for customer review will increase food safety because consumers can make informed choices regarding the food establishments they patronize.

The purpose of this Act is to require the department of health to publish food establishment violations on its web site each month, and to require a food establishment, upon request, to permit a customer to view a copy of the current inspection report, including inspection findings, any violations found, and any penalty.

SECTION 2. Section 321-4.5, Hawaii Revised Statutes, is amended to read as follows:

"[[]§321-4.5[]] Inspection of food establishments. (a) Inspections of food establishments may be performed only by a registered sanitarian or a food and drug inspector.

(b) The department shall publish a monthly report on its web site of any food establishment inspected the previous month that was cited for a violation of any applicable rules and regulations including the name and address of the food establishment, date of the inspection, description of the violation, and dollar amount of the penalty.

(c) All food establishments shall:

(1) Maintain a copy of the most recent inspection report including all inspection findings, any violation found, and any penalty imposed on the food establishment including the dollar amount of any fine; and

(2) Upon request, permit a customer to view a copy of the most recent inspection report including all inspection findings, any violation found, and any penalty imposed on the food establishment including the dollar amount of any fine."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
