A BILL FOR AN ACT

 

relating to controlled substances.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 329, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§329- Ephedrine; pseudoephedrine. (a) Any compound, mixture, or preparation containing any detectable quantity of ephedrine, its salts, optical isomers, and salts of optical isomers, or pseudoephedrine, its salts, optical isomers, and salts of optical isomers shall be dispensed, sold, or distributed only by a licensed pharmacist or a licensed pharmacy technician.

(b) Any person purchasing, receiving, or otherwise acquiring any compound, mixture, or preparation as provided in subsection (a) shall produce a photo identification showing the person's date of birth and shall sign a written log or receipt showing the date of the transaction, name of the person, and the amount of the compound, mixture, or preparation.

(c) No person shall purchase, receive, or otherwise acquire any compound, mixture, or preparation within any thirty-day period that contains more than nine grams of ephedrine or pseudoephedrine; provided that this section shall not apply to any quantity of compound, mixture, or preparation dispensed pursuant to a valid prescription.

(d) This section shall not apply to any compound, mixture, or preparation that is in liquid, liquid capsule, or gel capsule form if ephedrine or pseudoephedrine is not the only active ingredient."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
