A BILL FOR AN ACT

 

RELATING TO THE PATIENTS' BILL OF RIGHTS AND RESPONSIBILIITES ACT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 432E-6.5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) An enrollee may request that the following be conducted as an expedited appeal:

(1) The internal review under section 432E-5 of the enrollee's complaint; or

(2) The external review under section 432E-6 of the managed care plan's final internal determination.

If a request for expedited appeal is approved by the managed care plan or the commissioner, the appropriate review shall be completed within seventy-two hours of receipt of the request for expedited appeal. The commissioner may conduct an expedited external appeal hearing alone without appointing an external review panel; provided that the commissioner has made a reasonable effort and has failed to recruit a physician for the external review panel."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon approval.
