A BILL FOR AN ACT
relating to hawaii-based television and film production.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 201, Hawaii Revised Statutes, is amended by adding a new section to part IX to be appropriately designated and to read as follows:
"§201- Film facility; discounted rental for Hawaii-based television or film production businesses. (a) Notwithstanding section 201-2.5, or any other law to the contrary, the department shall provide to qualified Hawaii-based television or film production businesses a discount of at least fifty per cent of the department's standard film facility lease rent.
(b) For the purposes of this section, "qualified Hawaii-based television or film production business" means any person, agency, corporation, or other business entity that has its principal place of business located in the State and that is not a subsidiary of a major television or film production company.
(c) The department shall adopt rules pursuant to chapter 91 to establish guidelines and criteria to determine whether a Hawaii-based television or film production business is a subsidiary of a major film or television production company and to otherwise effectuate the purpose of this section.
(d) The department shall annually report to the legislature at least twenty days prior to the convening of each regular session on the discounted lease rents provided to qualified Hawaii-based television or film production businesses. The report shall include but not be limited to:
(1) The names of the entities receiving the discounted lease rent;
(2) The types of productions being produced by the qualified Hawaii-based television or film production businesses utilizing the discounted lease rent;
(3) The length of the lease terms of the qualified Hawaii-based television or film production businesses utilizing the discounted lease rent; and
(4) A breakdown of film facility revenues lost due to the implementation of the discounted lease rent."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
