A BILL FOR AN ACT

 

relating to tort actions.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 663, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§663- Gasoline dealer immunity. (a) A gasoline dealer shall be immune from liability for injuries to the person, or damage to the property, of any party caused by a motor vehicle operated by a person to whom the retail seller sold gasoline.

(b) For the purpose of this section, "gasoline" and "gasoline dealer" have the same meaning as defined in section 486H-1."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
