A BILL FOR AN ACT

 

relating to identity theft.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 708, part IV, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§708-   Unauthorized possession of mail. (a) A person commits the offense of unauthorized possession of mail if the person obtains, or exerts control over, the mail of another with intent to use the mail to commit the offense of identity theft under this chapter.

(b) Unauthorized possession of mail is a class C felony."

SECTION 2. Chapter 708, part X, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§708-   Unsolicited credit card offers prohibited. (a) A credit card issuer shall not mail to any person in this State an unsolicited offer to issue a credit card.

(b) Mailing unsolicited credit card offers under subsection (a) is a violation."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
