A BILL FOR AN ACT

 

relating to building codes.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46- Building codes. (a) Notwithstanding any law to the contrary, the State hereby adopts for itself the latest editions of:

(1) The International Building Code;

(2) The International Residential Code;

(3) The International Mechanical Code; and

(4) The International Plumbing Code,

as published by the International Code Council, as their building code.

(b) All state projects shall be in compliance with the latest editions of each of the codes listed in subsection (a).

(c) Each political subdivision of the State shall use the latest editions of each of the codes listed in subsection (a) as its building code no later than January 1, 2009.

(d) As used in this section, state project means "any project or program initiated by a state agency or requiring the use of state funds."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
