A BILL FOR AN ACT
relating to correctional facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The governor and the department of public safety shall develop a plan that is financially advantageous to the State that would execute the sale of the real property and facilities upon which the Oahu community correctional center facility is situated and utilize the revenues derived therefrom to repay any debt incurred by the State to expand the Halawa correctional facility to accommodate the functions provided by the Oahu community correctional facility.
SECTION 2. The governor shall submit a report to the legislature, not later than twenty days prior to the convening of the 2007 regular session, on the plan required under section 1 of this Act and any other actions taken by the governor and the department of public safety pursuant to this Act. The plan and report shall include but not be limited to:
(1) The appraised value and, if different, the proposed sale price for which the real property and facilities upon which the Oahu community correctional center facility is situated would be sold;
(2) The estimated cost of expanding the Halawa correctional facility to accommodate the capacity of the Oahu community correctional center and the functions provided by the Oahu community correctional center;
(3) The estimated cost of expanding the combined facility to accommodate a growing incarcerated correctional facility population as projected by the department of public safety;
(4) A proposed project timeline to execute the plan;
(5) Any draft legislation that may be necessary to effectuate the sale of the Oahu community correctional center or the expansion of the Halawa correctional facility pursuant to this Act; and
(6) Any other information the governor, the department of public safety, or the legislature deems appropriate.
SECTION 3. This Act shall take effect upon its approval.
