A BILL FOR AN ACT

 

relating to kawai nui marsh.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Kawai Nui marsh, encompassing approximately eight hundred thirty acres of land in Kailua, Oahu, is the State's largest remaining wetland and an ecological treasure. It has been identified by the United Sates Fish and Wildlife Service as a primary habitat for endemic and endangered native Hawaiian birds. Last year, the Ramsar Convention on Wetlands designated Kawai Nui marsh a wetland of international importance.

Act 47, Session Laws of Hawaii 1998, transferred the bulk of the land at Kawai Nui marsh to the State; however, the city and county of Honolulu and the United States Army Corps of Engineers were to have completed all flood control projects in the marsh and the State was to enter into any required operation and maintenance agreement with the United States Corps of Engineers.

SECTION 2. The city and county of Honolulu is directed to comply with the requirements of Act 47, Session Laws of Hawaii 1998, by July 1, 2006. Further Act 47, Session Laws of Hawaii 1998, notwithstanding, the city and county of Honolulu shall continue to maintain Kaelepulu drainage channel and all feeder drains to the Kaelepulu drainage channel.

SECTION 3. All land transfers required by Act 47, Session Laws of Hawaii 1998, shall be completed no later that July 1, 2006.

SECTION 4. This Act shall take effect upon its approval.
