A BILL FOR AN ACT

 

relating to ocean recreation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the department of land and natural resources currently regulates individual surfing instructors, who must fulfill certain qualifications in order to receive a permit. Although the department issues permits to these individuals, enforcement of surfing permit regulations is often difficult because many surfboard instructors are employed and come under the supervision of surfing schools. The legislature finds that it is the public interest and safety to require that surfing schools be included in the department regulations covering surfing instructors.

The purpose of this Act is to require the department of land and natural resources to regulate surfing schools in its regulation governing surfing instruction.

SECTION 2. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§200-   Regulation of surfing schools; permits. The department shall include in its regulation of surfing instruction the issuance of permits to surfing schools through rules adopted pursuant to chapter 91.

As used in this section, "surfing school" means any business that employs one or more surfboard instructor permit holders. The board of land and natural resources may adopt interim rules for surfing schools based on current rules governing surfboard instructors. The interim rules shall be effective for no more than eighteen months or until rules are adopted, whichever occurs first."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2006.
