A BILL FOR AN ACT

 

RELATING TO WATER CONSERVATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46- Water conservation standards for building design and construction. (a) Every county building code shall require that all new residential and commercial developments be equipped with water conservation devices. The requirements of this section shall be applicable to building permits issued after December 31, 2006. This section shall not apply to exempted buildings.

(b) The water conservation building standards shall be enforced at the time of construction of a new building.

(c) No official of the State or of any county charged

with the enforcement of laws or ordinances pertaining to the construction of buildings or structures shall accept or approve any plan or specification, including or pertaining to the design and construction details and standards for a water system unless the water conservation building standards are met.

(d) All plans and specifications submitted with or in

connection with an application for a building or construction permit shall bear the certification of a registered architect or engineer that the plans and specifications comply with the water conservation building standards.

(e) For the purposes of this section:

"Exempted building" means:

(1) Any building owned or leased in whole or in part by the United States; or

(2) Any building that is deliberately preserved beyond its normal term of use because of historic significance, architectural interest, public policy, or qualification for special historic building code provisions.

"Water conservation devices" includes but shall not be limited to low-flow plumbing, low-flush toilets, faucet aerators, and any other economically reasonable machinery, equipment, or devices used in the water conservation process that are commercially available at the time of development to reduce water usage from existing groundwater sources."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
