A BILL FOR AN ACT
relating to construction materials.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Use of pervious pavement. (a) Effective January 1, 2008, no county agency shall issue a permit for new residential, commercial, or public construction unless all pavement used in the construction consists of pervious pavement; provided that pervious pavement shall not be required where its use:
(1) Would threaten existing water quality or public health and safety, as determined by the department of health; or
(2) Would seriously threaten permitted ground or surface water uses within a designated water management area, as determined by the commission on water resource management.
(b) For the purposes of this section:
"Pavement" includes sidewalks, driveways, and roads but excludes the foundation of a building.
"Pervious pavement" includes but is not limited to cement blends, grasscrete, gravel, and other materials with the ability to:
(1) Allow water to seep through the paved surface and into the soil as nature intended; and
(2) Reduce or eliminate the need and the cost of expensive stormwater drainage systems and retention areas."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
