A BILL FOR AN ACT
relating to speeding.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- Excessive speeding. (a) No person shall drive a vehicle at a speed exceeding the posted speed limit by thirty miles per hour or more.
(b) Violation of this chapter shall be a petty misdemeanor.
(c) Subsequent violations of this chapter shall be a misdemeanor.
(d) In addition to any penalties or fines imposed for a first violation of this chapter, the court shall also impose a license suspension not to exceed one year. In addition to any penalties or fines imposed for subsequent violations of this chapter, the court shall also impose the following penalties:
(1) A license revocation for a period not to exceed three years;
(2) At least 300 hours of community service, should the court decide to forego a term of imprisonment; and
(3) Completion of a driver's education course."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
