A BILL FOR AN ACT

 

RELATING TO MOTOR VEHICLES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 708-836.5, Hawaii Revised Statutes, is amended to read as follows:

"[§708-836.5] Unauthorized entry into motor vehicle. [(1)] (a) A person commits the offense of unauthorized entry into motor vehicle if:

(1) the person intentionally or knowingly enters or remains unlawfully in a motor vehicle with the intent to commit a crime against a person or against property rights; or

(2) the person intentionally or knowingly enters or remains unlawfully in a motor vehicle without the permission of the registered owner.

[(2)] (b) Unauthorized entry into motor vehicle under subparagraph (a)(1) is a class C felony. Unauthorized entry into motor vehicle under subparagraph (a)(2) is a misdemeanor. Subsequent violations of subparagraph (a)(2) within a ten year period from the conviction of the previous offense shall be a class C felony."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
