A BILL FOR AN ACT
RELATING TO FERAL CHICKENS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 322, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§322- Feral chickens; dispostion. Feral chickens shall be treated as a nuisance by the department of health and disposed of as provided by this chapter.
For the purposes of this section, "feral chicken" means an undomesticated chicken that is not owned by, or survives without the care of, any person or business. A feral chicken is not "poultry" as that term is defined under section 161-3."
SECTION 2. Section 161-3, Hawaii Revised Statutes, is amended by amending the definition of "poultry" to read as follows:
""Poultry" means any domesticated bird, whether live or dead[.] and does not include feral chickens as defined under 322- ."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
