A BILL FOR AN ACT

 

RELATING TO HEALTH INSURANCE RATE OVERSIGHT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to make permanent health insurance rate oversight to protect the public welfare and the welfare of consumers by ensuring that health insurance rates:

(1) Are not excessive, inadequate, or unfairly discriminatory;

(2) Shall not tend to have the effect of destroying competition or establishing a monopoly; and

(3) Shall be reasonable in relation to benefits provided.

SECTION 2. Act 74, Session Laws of Hawaii 2002, as amended by section 22, Act 3, Session Laws of Hawaii 2003, is amended by amending section 6 to read as follows:

"SECTION 6. This Act shall take effect on January 1, 2003[; provided that this Act shall be repealed on June 30, 2006; and provided further that sections 432:1-102(b) and 432D-19(d), Hawaii Revised Statutes, shall be reenacted in the form in which they read on the day before the effective date of this Act]."

SECTION 3. Statutory material to be repealed is bracketed and stricken.

SECTION 4. This Act shall take effect on June 29, 2006.
