Adjoining landowner liable for damage to animals and fences if landowner maintains a structure, use, or condition that attracts animals and causes them to break a lawful fence.

A BILL FOR AN ACT

SECTION 1. Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

"§142- Adjoining landowner liability. An adjoining landowner shall be liable for damage to a fence, if the landowner maintains a structure, use, or condition on the landowner's land that the landowner knowingly creates and perpetuates that attracts animals mentioned in section 142-63 and causes the animals to break a lawful fence."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
