A BILL FOR AN ACT
relating to labeling and identification of genetically modified fish and fish products.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:
"Chapter
GENETICALLY MODIFIED FISH AND FISH PRODUCTS
§ -1 Genetically modified fish and fish products; labeling; identification. (a) No fish or fish product may be sold in the State if the fish or fish product is misbranded.
(b) A fish is misbranded if the fish is a genetically modified fish or genetically modified fish product and:
(1) If the fish or fish product is sold in a packaged form, the package is not conspicuously labeled to identify the fish or fish product as a genetically modified fish or fish product; or
(2) If the fish or fish product is sold in an unpackaged form, the food is not conspicuously identified as a genetically modified fish or fish product.
(c) For the purposes of this chapter, unless the context clearly requires otherwise:
"Genetically modified fish" means:
(1) A finfish or shellfish whose genetic structure has been altered at the molecular level by means that are not possible under natural conditions or processes, including recombinant DNA and RNA techniques, cell fusion, gene deletion or doubling, introduction of exogenous genetic material, alteration of the position of a gene, or similar procedure; or
(2) The progeny of a finfish or shellfish described in paragraph (1).
"Genetically modified fish product" means a product prepared from a genetically modified fish."
SECTION 2. This Act shall take effect upon its approval.
