A BILL FOR AN ACT

 

RELATING to dogs.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§142-   Muzzle and leash required; penalty. (a) No dog shall be permitted in or on a public street, on public school grounds, or in any other place open to the public, except when muzzled and under the control of the owner by leash, cord, chain, or other similar means of physical restraint; provided that:

(1) The muzzle shall consist of a leather, wire, plastic, or cloth strap or restraining appliance that, when fitted over the dog's snout, prevents the dog from biting; and

(2) The leash, cord, chain, or other means is not more than eight feet in length.

(b) This section shall not apply if the owner has taken and completed with the dog the American Kennel Club's "Canine Good Citizen" course or other obedience course taught by an instructor certified by the National Association of Dog Obedience Instructors or the Association of Pet Dog Trainers.

(c) This section shall not be construed to permit anything that is prohibited by any other law.

(d) Violation of this section is a petty misdemeanor."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
