A BILL FOR AN ACT

 

relating to harbors.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 266, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§266- Honolulu harbor; limited uses. (a) Any leases, licenses, right of entry, or other dispositions of the use of any lands or improvements in the Honolulu commercial harbor shall be limited to activities in the following order:

(1) First to maritime cargo operations, including cargo shipping, transport, and storage;

(2) Second to commercial fishing operations;

(3) Third to cruise ship and other maritime commercial and recreational operations; and

(4) Lastly, to other activities involved in commercial harbor operations and shipping.

(b) No land or improvements within the Honolulu commercial harbor presently utilized for maritime cargo operations, including shipping, transportation, and storage, shall be converted to any other use."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
