A BILL FOR AN ACT
relating to assisted living facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Assisted living facilities; permitted use in residential areas. (a) For the purposes of zoning, assisted living facilities shall be considered a residential use of property and shall be a permitted use in all residentially designated zones, including but not limited to zones for single-family dwellings. No conditional use permit, variance, or special exception shall be required for residences used as assisted living facilities.
(b) For the purposes of this section, "assisted living facility" means a combination of housing, health care services, and personalized supportive services designed to respond to individual needs, to promote choice, responsibility, independence, privacy, dignity, and individuality."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
