A BILL FOR AN ACT

 

relating to health.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the office of litter control was established administratively within the department of health in 1980 and was terminated in 1996 due to budgetary constraints. The legislature further finds that the office of litter control was very successful in its efforts to clean up, prevent, and educate the public about litter. Among its accomplishments were: annual statewide recycling campaign, including a fundraising program from businesses; annual statewide litter campaign; involvement of volunteers from organizations and a training program for volunteers; resolving complaints of littered sites, including derelict vehicles; raising funds from organizations and individuals; establishing partnerships with civic service and community groups, school and other youth organizations, and businesses; community work day program; and shoreline and coastal cleanup.

Community Work Day Program, which is a section 501(c)(3) federal nonprofit tax exempt organization and a part of the national Keep America Beautiful program, partners with businesses, government, and the community, and uses donations and in-kind contributions to create successful education and action-oriented programs such as education and activities for students and adults, island-wide cleanups, roadside beautification programs, community revitalization such the Ala Wai cleanup, renovation of Old Maui High School in Hamakuapoko, cleanup of polluted streams, and renovation and reuse of dilapidated buildings.

The purpose of this Act is to establish the office of litter and to make an appropriation.

SECTION 2. Section 339-1, Hawaii Revised Statutes, is amended by amending the definition of "director" to read as follows:

""Director" means the director of [the department of] health."

SECTION 3. Section 339-3, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) The director shall:

(1) Be responsible for the study of available research in the field of litter control, prevention, removal, disposal, and recycling; the study of methods for the implementation of such research; and development of public educational programs;

(2) Serve as a coordinator between the State, state agencies, and various organizations seeking to aid in the anti-litter effort;

(3) Cooperate with local governments to accomplish the coordination of anti-litter efforts; [and]

(4) Encourage voluntary local anti-litter campaigns[.]; and

(5) Establish an office of litter control for purposes of implementing the director's duties under this section, with functions deemed appropriate by the director; provided that at a minimum the office shall provide for the implementation of the community work day program as a part of the national Keep America Beautiful program."

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2005-2006, and the same sum, or so much thereof as may be necessary for fiscal year 2006-2007, for the establishment and operation of a litter control office as provided in this Act.

The sum appropriated shall be expended by the department of health for purposes of this Act.

SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 6. This Act shall take effect on July 1, 2005.
