Makes it a class C felony to commit the offense of promoting pornography within 1,000 feet of a school campus or public park.

A BILL FOR AN ACT

SECTION 1. Section 712-1214, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:

"(2) Promoting pornography is a misdemeanor[.]; provided that the offense is a class C felony if it is committed within one thousand feet of the real property comprising a school, as defined in section 712-1249.6, or public park."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
