A BILL FOR AN ACT

 

relating to the pearl harbor tunnel feasibility study.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that by, Act 178, Session Laws of Hawaii 2005, $200,000 was appropriated from the proceeds of special revenue bonds to fund a study of the feasibility of building a tunnel under Pearl Harbor from Sand Island to Ewa Beach. The study would identify potential routes for a tunnel or underpass through Pearl Harbor, the potential location of portals for the tunnel, and measures that could be taken to construct the tunnel in a way that would allay concerns of the United States armed forces regarding shared civilian and military use of the Pearl Harbor area. However, the governor has declared her intent to restrict or withhold the funds on conditions that will frustrate the purpose of the appropriation.

The purpose of this Act is to clarify the legislature's intent that the that funds appropriated by Act 178, Session Laws of Hawaii 2005, for a Pearl Harbor tunnel feasibility study be released and expended for the purpose intended without restriction, condition, or delay by the governor.

SECTION 2. The governor shall release forthwith the $200,000 appropriated by Act 178, Session Laws of Hawaii 2005, for a feasibility study for a tunnel under Pearl Harbor from Sand Island to Ewa Beach, without regard to chapter 37, part II, Hawaii Revised Statutes. Any conditions, restriction, or delay imposed by the governor shall be deemed as a matter of law to be void as against public policy.

SECTION 3. This Act shall take effect upon its approval.
