A BILL FOR AN ACT

 

making an appropriation for special education services provided by charter schools.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that during fiscal years 2001-2002 and 2002-2003, charter schools did not receive the full reimbursement for special education services that were appropriated for all public schools during those years. School services were rendered, but the per pupil reimbursement for these students were not paid to the charter schools.

The legislature also finds that the law has since been changed to resolve the oversight, but repayment for the two past fiscal years has not been made. The purpose of this Act is to reimburse the charter schools for expenses that were supposed to be compensated by the department of education.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,900,000, or so much thereof as may be necessary for fiscal year 2006-2007, for reimbursement of charter schools for special education services provided in fiscal years 2001-2002 and 2002-2003.

SECTION 3. The sum appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2006.
