A BILL FOR AN ACT
RELATING TO RESTORING THE RULEMAKING AUTHORITY OF THE DIRECTOR OF LABOR AND INDUSTRIAL RELATIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 386-72, Hawaii Revised Statutes, is amended to read as follows:
"§386-72 Rulemaking powers. [Repeal and reenactment on July 1, 2007. L Sp 2005, c 11, §14.] In conformity with and subject to chapter 91, the director of labor and industrial relations shall make rules, not inconsistent with this chapter, which the director deems necessary for or conducive to its proper application and enforcement[; provided that the rules were adopted prior to January 1, 2005. No rules adopted or amended on or after January 1, 2005, pertaining to any workers' compensation standard or procedure arising under this chapter shall have the force and effect of law; provided, however, that annual updates in the medical fee schedules specific to the amount paid to medical providers as provided in section 386-21(c) may be made consistent with this chapter]."
SECTION 2. Statutory material to be repealed is bracketed and stricken.
SECTION 3. This Act shall take effect upon its approval.
