STATE OF HAWAII

A BILL FOR AN ACT

relating to gasoline dealers.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. With gasoline prices at record highs, it is imperative that motorists keep their automobiles running at optimum condition. Water for cooling engines and compressed air to ensure proper tire pressure both contribute to obtaining the optimum miles per gallon.

Accordingly, the purpose of this Act is to require gasoline dealers to provide water and compressed air to service vehicles.

SECTION 2. Chapter 486H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§486H- Provision of water, compressed air, and pressure gauges. (a) Every retail station, during operating hours, shall provide and make available water, compressed air, and a gauge for measuring air pressure.

(b) Every retail station shall display, at a conspicuous place on, at, or near each side of each dispensing island, a sign that shall read as follows: "HAWAII STATE LAW REQUIRES THIS STATION TO PROVIDE WATER, COMPRESSED AIR, AND A TIRE PRESSURE GAUGE. IF YOU HAVE A COMPLAINT, NOTIFY THE STATION ATTENDANT OR CALL THE FOLLOWING TELEPHONE NUMBER (808) - ." The sign shall be printed in capital, block-style letters at least two inches tall using bold black lettering against a white background and shall be legible at all times."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on September 1, 2006.
