A BILL FOR AN ACT
RELATING TO CHAPTER 846e.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 846E-1, Hawaii Revised Statutes, is amended as follows:
1. By adding two new definitions to be appropriately inserted and to read:
""Violent offender" means:
(1) A person who is or has been convicted at any time, whether before or after the effective date of this Act, of a "violent offense"; or
(2) A person who is or has been charged at any time, whether before or after the effective date of this Act, with a "violent offense" and is or has been found unfit to proceed and is or has been released into the community or who is acquitted due to a physical or mental disease, disorder, or defect pursuant to chapter 704 and is released into the community.
"Violent offense" means an offense that is:
(1) Set forth in section 707-701, 707-701.5, 707-702, 707-710, 707-712.5, 707-720, 708-820, 708-840, 708-841, or 709-906 (third or subsequent conviction);
(2) A criminal offense resulting in a federal, military, or out-of-state conviction that would be an offense defined in paragraph (1); or
(3) A criminal offense, as defined in chapter 705, that is an attempt, criminal solicitation, or criminal conspiracy to commit an offense defined in paragraph (1)."
2. By amending the definition of "covered offender" and "covered offense" to read:
""Covered offender" means a "sex offender," [or] an "offender against minors," or a "violent offender," as defined in this section.
"Covered offense" means a criminal offense that is:
(1) A crime within the definition of "crimes against minors" in this section; [or]
(2) A crime within the definition of "sexual offense" in this section[.]; or
(3) A crime within the definition of "violent offense" in this section."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
