A BILL FOR AN ACT
relating to residential landlord-tenant code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 521, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§521- Payment for utilities supplied to multiple and separate tenant premises. The landlord shall be responsible for the payment of utilities where:
(1) Utilities are supplied to premises that are divided into units occupied by separate tenants of the landlord; and
(2) Utility usage is recorded as an undivided amount on a single meter.
The landlord may require of the tenants equitable reimbursement for utilities, separate from any rent obligation, if the requirement is plain and clearly noted as part of the rental agreement. The total reimbursement from all the separate tenants shall not exceed the actual payment made by the landlord to meet the obligation of payment for utility usage.
For the purpose of this section, "utility" means electricity, water, and gas."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
