A BILL FOR AN ACT
RELATING TO SALARY COMPENSATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§78- Salary compensation for officers and employees on active military service. (a) The State shall compensate the difference in pay for officers and employees of the State who are placed on active duty and serving in a hostile fire zone designated by presidential executive order; provided that the gross monthly state pay exceeds the gross monthly military pay. Compensation shall consist of the difference between the gross monthly state pay and the gross monthly military pay. For the purposes of this section, "gross monthly military pay" shall include basic pay, all authorized allowances, and all incentive and special pay.
(b) This section shall also apply retroactively to officers and employees of the State who:
(1) Were placed on active duty and served in a hostile fire zone designated by presidential executive order; and
(2) Completed their tours of duty in calendar years 2003 and 2004."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
