A BILL FOR AN ACT

 

relating to traffic.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that it is critical for Hawaii's highways and roads to accommodate traffic flows efficiently, safely, and quickly. The intersection of Kalanianaole Highway and Ulupii Street in Kailua, Oahu is a particularly congested and hazardous intersection. Thousands of vehicles, including many large trucks, travel through this intersection on a daily basis, and reports of accidents and near misses occur frequently and regularly. The intersection is dangerous for motorists and pedestrians alike. With several schools in the area, including Kailua high school and Maunawili elementary school, there is much concern for the safety of children crossing at the intersection.

In the interest of preserving the public health, safety, and welfare, the purpose of this Act is to direct the director of transportation to conduct a traffic light study of the intersection at Kalanianaole Highway and Ulupii Street.

SECTION 2. The director of transportation shall undertake a traffic light study of the intersection of Kalanianaole Highway and Ulupii Street in Kailua, Oahu.

The director shall submit a written report of findings and recommendations to the governor and the legislature no later than December 31, 2005, including any necessary proposed legislation to implement the study's recommendation.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2005-2006, for the traffic light study at the intersection of Kalanianaole Highway and Ulupii Street.

The sum appropriated shall be expended by the department of transportation for the purpose of this Act.

SECTION 4. This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2005.
