A BILL FOR AN ACT
relating to pseudoephedrine.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 461, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§461- Pseudoephedrine. (a) Any material, compound, mixture, or preparation that contains any quantity of pseudoephedrine, its salts, optical isomers, and salts of optical isomers as the only active ingredient, or in combination with other active ingredients, shall be dispensed, distributed, or sold by a registered pharmacist.
(b) Any material, compound, mixture, or preparation that contains any quantity of pseudoephedrine, its salts, optical isomers, and salts of optical isomers as the only active ingredient, or in combination with other active ingredients, shall be displayed and stored behind the counter and under the direct supervision of a registered pharmacist.
(c) Notwithstanding any other law, a registered pharmacist shall not dispense, distribute or sell more than six grams of any material, compound, mixture, or preparation containing any detectable quantity of pseudoephedrine, its salts, optical isomers, and salts of optical isomers, to any one person within a thirty day period; provided that this limit shall not apply to any quantity of such material, compound, mixture, or preparation that is dispensed pursuant to a valid prescription.
(d) No person shall purchase or otherwise acquire more than six grams of any material, compound, mixture, or preparation containing any detectable quantity of pseudoephedrine, its salts, optical isomers, and salts of optical isomers within any thirty day period; provided that this limit shall not apply to any quantity of such material, compound, mixture, or preparation that is dispensed pursuant to a valid prescription.
(e) Any person purchasing or otherwise acquiring any material, compound, mixture, or preparation that contains any quantity of pseudoephedrine, its salts, optical isomers, and salts of optical isomers as the only active ingredient, or in combination with other active ingredients, shall:
(1) Produce identification containing the person's photograph, printed name, and signature; and
(2) Sign a log that displays the person's name, the date of the transaction, and the amount of the material, compound, mixture, or preparation.
(f) Every pharmacy shall keep a suitable book or file, or a microfilm of such book or file, in which shall be preserved, for a period of not less than five years, a record of every material, compound, mixture, or preparation that contains any quantity of pseudoephedrine, its salts, optical isomers, and salts of optical isomers as the only active ingredient, or in combination with other active ingredients, that is dispensed, distributed, or sold by a registered pharmacist including:
(1) The name of the person purchasing or otherwise acquiring the material compound, mixture, or preparation;
(2) The date of the transaction;
(3) The amount of the material, compound, mixture, or preparation dispensed, distributed, or sold to the person; and
(4) The signature log pursuant to subsection (e)(2).
(g) Any book, file, or microfilm kept pursuant to subsection (f) shall at all times be open to inspection by the board of pharmacy and other law enforcement officers."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
