A BILL FOR AN ACT
RELATING TO THE HAWAIIAN HOMES COMMISSION ACT, 1920, AS AMENDED.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaiian Homes Commission Act, 1920, as amended, is amended by adding a new section to be appropriately designated and to read as follows:
"§ - Business relationships. Notwithstanding any law to the contrary, the department may, either alone or jointly with any governmental agency, enter into a business relationship as deemed necessary or appropriate by the commission, including but not limited to:
(1) Creating a nonprofit corporation that is controlled wholly by the department or jointly with others;
(2) Establishing, subscribing to, or owning stock in a business corporation, individually or jointly with others; or
(3) Entering into a partnership or other joint venture arrangement, or participating in an alliance or other cooperative arrangement with any public or private entity;
provided that any business relationship with a corporation or venture or other arrangement entered into under this section shall further the purposes of the Act; provided further that this section shall not be construed to authorize the department to abrogate any responsibility or obligation under the Act."
SECTION 2. The provisions of this amendment under this Act are declared to be severable, and if any section, sentence, clause, or phrase, or the application thereof to any person or circumstance is held ineffective because there is a requirement of having the consent of the United States to take effect, then that portion only shall take effect upon granting of consent by the United States and the effectiveness of the remainder of this amendment or the application thereof shall not be affected.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
