A BILL FOR AN ACT

 

RELATING TO GOVERNMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Act 51, Session Laws of Hawaii 2004, required a major reorganization of state government to reduce bureaucracy and improve the responsiveness and service delivery of the department of education. The 2004 legislature recognized that a reorganization of this magnitude required prudent precaution at each step, including the possible repeal or modification of existing powers, functions, duties, and resources transferred from various state agencies to the department of education through subsequent legislation.

The act of transferring civil service employees between executive branch agencies and the department of education may adversely affect these employees' rights and benefits. For example, if civil service employees transferred to the department of education become subject to a separate personnel system under the control of the board of education, these employees would have restricted opportunities for transfers and promotions.

It is the purpose of this Act to permit those civil service employees transferred from executive branch agencies to the department of education under Act 51, Session Laws of Hawaii 2004, to retain the right to apply for intra- and inter-departmental transfer and promotional opportunities within the executive branch.

SECTION 2. Chapter 76, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§76- Internal, transfer, and promotional opportunities. Civil service employees transferred under Act 51, Session Laws of Hawaii 2004, shall be eligible to apply for intra- and inter-departmental transfer and promotional opportunities within the executive branch."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2005.
