A BILL FOR AN ACT

 

relating to a state public Market.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that in order to promote economic development within the State, we must capitalize on the rich diversity of the people and culture of Hawaii. The creation of new and meaningful business opportunities for Hawaii entrepreneurs, including those for local farmers, will help to spur growth in our State's economy. Across the nation, cities, including Seattle, Washington; Portland, Maine; Los Angeles, California; and New York City, New York, have experienced great economic success as a result of the establishment of local public-markets and local farmer's markets.

The purpose of this Act is to enable and support the establishment of a permanent public market within the city and county of Honolulu, State of Hawaii, on not less than ten acres of state-owned land that lies within the Kakaako Makai area.

The public market shall provide a venue for locally-owned businesses that are vendors of locally made products, locally created artworks and crafts, locally produced entertainment events, and locally grown produce. Additionally, the public market shall incorporate private and public entities that are designed to educate both tourists and local residents regarding Hawaii's history and culture. The public market shall also incorporate private and public entities that provide vocational training in fields related to those undertaken within the public market.

SECTION 2. (a) The department of business, economic development, and tourism shall establish, oversee, and have full and final decision making authority in the process of establishing a permanent state public market. To that end, the department shall:

(1) Designate the state-owned land that shall be used for the public market;

(2) Accept, for consideration, input regarding the establishment of the public market from the Hawaii community development authority, the department of agriculture, the department of land and natural resources, the department of labor and industrial relations, the Hawaii Food Industry Association, Inc., and the University of Hawaii;

(3) Develop, distribute, and accept requests for proposals from private entities for plans to develop and operate the public market; and

(4) Consider and determine the propriety of utilizing public-private partnerships in the development and operation of the public market.

SECTION 3. The public market shall:

(1) Include a public parking lot that shall be operated by the State; and

(2) Require that all retail product vendors sell products of which not less than fifty per cent have been produced within the State.

SECTION 4. Requests for proposals for the public market shall contemplate the inclusion of the following types of facilities and services:

(1) Retail outlets for locally-produced and locally-grown products;

(2) Venues for locally-owned businesses, including restaurants and other service-related businesses;

(3) Theaters, stages, and arenas designed to showcase local performing artists, as well as community performing arts;

(4) Exhibition space or museums that showcase artwork created by local artists;

(5) Museums or other educational facilities focusing on Hawaiian history and culture;

(6) Banquet facilities and meeting facilities to be used by businesses, residents, and community organizations;

(7) Employment training facilities, including but not limited to business, vocational, occupational, and trade school facilities, with employment training for Hawaii residents to be conducted by the vendors and others; and

(8) Practice and training facilities for physical activities, including but not limited to organized sports, martial arts, and other exercise and fitness activities.

SECTION 5. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2005-2006, and the same sum, or so much thereof as may be necessary for fiscal year 2006-2007, to accomplish the provisions of this Act.

SECTION 6. The sums appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

SECTION 7. This Act shall take effect on July 1, 2005.
