Description:
Repeals the 30 day prison term for driving without a license for drivers whose license to operate mopeds, motor scooters, motorcycles, passenger cars, and trucks or vans having a gross vehicle weight rating of 15,000 pounds or less expired within the 90 days preceding the violation and imposes a maximum $1,000 fine instead.

A BILL FOR AN ACT
RELATING TO EXPIRED DRIVER'S LICENSE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 286-136, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) Except as provided in this subsection and in subsection (b), any person who violates section 286-102, 286-122, 286-130, 286-131, 286-132, 286-133, or 286-134 shall be fined not more than $1,000 or imprisoned not more than thirty days, or both[.]; provided that any person who violates section 286-102 within ninety days after expiration of an otherwise valid license to operate the category of vehicles specified in section 286-102(b)(1) to (3) shall be fined not more than $1,000. Any person who violates any other section in this part shall be fined not more than $1,000."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
