A BILL FOR AN ACT
RELATING TO MOTOR VEHICLES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 249, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§249- Exemptions for members of the national guard and reserves. Notwithstanding any other law to the contrary, one passenger motor vehicle owned by a member of the Hawaii national guard or United States military reserves domiciled in Hawaii who is:
(1) Federalized by a call to active duty through an order issued by the President of the United States; and
(2) Serving or has served in the central command area of operations,
shall be exempt from any taxes or fees required under this chapter in a manner similar to the exemption for nonresident military personnel under the Servicemembers' Civil Relief Act; provided that the exemption shall not exceed one year upon the member's return from active duty. This exemption shall not extend to a vehicle used for commercial purposes or to more than one vehicle owned by a Hawaii national guard or United States military reserve member."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2010.
