Appropriates funds for the Preschools Open Doors Program.

RELATING TO EARLY CHILDHOOD EDUCATION.

Creates a pilot program for universal access to early childhood education for children age 5 or younger whose families are unable to afford quality early childhood education. Makes appropriations.

RELATING TO EARLY CHILDHOOD EDUCATION.

improves early childhood education in the state by establishing a quality ratings committee and appropriating funds to allow the committee to develop a quality ratings system for early childhood education. Makes early childhood education more accessible to all children by increasing the number of childcare subsidies available through the preschools open doors program.

RELATING TO SCHOOLS.

Exempts private preschools and its programs that are part of a licensed elementary school from the licensing requirements imposed by the department of human services.

RELATING TO PUBLIC SCHOOL NUTRITION.

Establishes public school nutrition standards and food service manager nutrition training requirements. Requires the department of education to encourage schools to provide culturally appropriate nutrition education and farm-to-table education programs.

RELATING TO EDUCATION.

Appropriates funds for community-based youth leadership development camps on all islands in the State. Appoints the state student council to oversee the planning, implementation, and evaluation of these camps.

RELATING TO EDUCATION.

Establishes a grant program in the department of education to develop K-12 lesson plans, curriculum, and other educational materials for civic responsibility. Appropriates funds to DOE for social studies textbooks to support civic responsibility, science textbooks, and to the grant program.

Authorizes DOE to permit its employees and agents to administer medication, excluding insulin, to diabetic students in an emergency; establishes that DOE is not liable for any injury from self-administered or emergency administered medication of students.

Provides tax credit for taxes imposed by chapter 235 for real property taxes paid for, or improvements made to, agricultural lands.

Authorizes the Board of Agriculture to use certain animal quarantine facilities for reasonable rents or fees. Provides the means to deposit moneys derived from the use of animal quarantine facilities and property into the Animal Quarantine Special Fund.

Establishes an agricultural infrastructure improvement tax credit to promote agricultural diversity and increase agricultural self-sufficiency.

Declares that a person commits the crime of criminal trespass in the second degree if the person enters another person's cultivated or uncultivated agricultural land, that is enclosed by a fence or posted with signs forbidding trespass, without permission.

RELATING TO AGRICULTURAL LIABILITY.

Exempts qualified farmers from liability when a person who trespasses or commits, or attempts to commit, theft on the farmer's agricultural land is injured.

RELATING TO AGRICULTURE.

Exempts from processed food requirements and restrictions home-based agricultural producers of honey who sell less than 50 gallons of honey, sell directly to the consumer, and label their product as home-produced and processed.

RELATING TO DAIRY PRODUCTS.

Defines "raw milk," "raw colostrum," "raw-milk products", and "raw-colostrum products" and permits their sale to final consumers. Requires board of agriculture to adopt rules.

Authorizes the department of agriculture to charge user fees for the inspection and other invasive species prevention services provided by the department under chapter 150A, HRS. Also establishes an invasive species special fund.

Appropriates moneys for developmental disabilities residential service providers.

RELATING TO HUMAN SERVICES.

Authorizes the department of health to reimburse developmental disabilities residential services for individuals with developmental disabilities or mental retardation.

RELATING TO DEVELOPMENTAL DISABILITIES.

Provides that the plans of care for developmentally disabled persons provide for "support," and not training, of persons in the licensed developmental disabilities domiciliary homes. Requires DOH to determine the rate of payment for residents in licensed homes without specifying the methodology.

RELATING TO DEVELOPMENTAL DISABILITIES.

Requires community residential alternatives for persons with developmental disabilities or mental retardation to be in a setting of the person's choice if the person or the person's family and friends determine that the person can be sustained with supports, and the supports are attached to the person.

RELATING TO HEALTH.

Allows individuals with developmental disabilities to receive unlicensed home and community based services.

RELATING TO ADULT RESIDENTIAL CARE HOMES.

Requires DOH to adopt rules to allow a private pay resident in an expanded adult residential care home at the intermediate care facility level to have as the resident's case manager a family member who need not be a registered nurse.

RELATING TO INCOME TAXATION.

Allows an income tax credit to physicians and dentists practicing in medically or dentally underserved areas for a portion of the amount of medical or dental malpractice premiums.

RELATING TO LONG-TERM INSURANCE TAX CREDIT FOR SMALL BUSINESS.

Grants tax credit to small businesses at the lesser of 50% of premiums or $500 per employee for purchase of long-term care insurance for its employees. Defines small business as businesses employing less than 100 full-time or part-time workers.

RELATING TO LONG-TERM CARE.

Provides tax credit to resident taxpayers for long-term care insurance premiums at lesser of $2,500 or 50% of the amount of the insurance premium paid. If the tax credit is claimed, a medical expense deduction for long-term care insurance cost is prohibited.

MAKING AN APPROPRIATION FOR ADULT AND YOUTH DAY CARE.

Appropriates funds to Health for All to operate a pilot three-year project at the Waipahu Community Adult Day Health Care Center.

Add language that prohibits the Department of Human Services from restricting a physician's abililty to treat patients with mental illnesses though the use of a restrictive formulary, therapeutic substitution, or preferred drug classification.

RELATING TO PSYCHOLOGISTS.

Authorizes trained and supervised medical psychologists working in federally qualified health centers or other licensed health clinics located in federally designated medically underserved areas to prescribe psychotropic medications for the treatment of mental illness. Repeals prescriptive authority July 1, 2013.

RELATING TO RENTAL MOTOR VEHICLE SURCHARGE TAX.

Repeals the rental motor vehicle surcharge tax of $3 per day levied between September 1, 1999 and August 31, 2007.

RELATING TO TRAFFIC REGULATION WITHIN HOUSING AND COMMUNITY DEVELOPMENT CORPORATION OF HAWAII PROJECTS.

Repeals requirement that HCDCH needs to enter into contract with county before traffic can be regulated in HCDCH project by county.

RELATING TO USE OF INTOXICANTS.

Permits the forfeiture of a vehicle for conviction of operating a vehicle under the influence of an intoxicant within 5 years of 2 prior convictions or conviction of habitually operating a vehicle under the influence of an intoxicant.

RELATING TO TOWING.

Requires towing companies to make automated teller machines available when total charges exceed $100.

RELATING TO EXPIRED DRIVER'S LICENSE.

Repeals the 30 day prison term for driving without a license for drivers whose license to operate mopeds, motor scooters, motorcycles, passenger cars, and trucks or vans having a gross vehicle weight rating of 15,000 pounds or less expired within the 90 days preceding the violation and imposes a maximum $1,000 fine instead.

RELATING TO MOTOR VEHICLE NOISE.

Amends motor vehicle muffler noise law to provide a schedule of increased fines for the second, third, and subsequent violations.

RELATING TO NEGLIGENT HOMICIDE.

Amends definition of negligent homicide in the second degree to include death caused by driving more than thirty miles per hour over the speed limit. Clarifies that negligent homicide in the second degree may also apply to a person who operates a vehicle less than thirty miles per hour over the maximum speed limit in a negligent manner.

RELATING TO ADMINISTRATIVE LICENSE REVOCATION.

Permits driver whose license has been administratively revoked for life to seek reinstatement of the license after 10 years have passed since the lifetime revocation. Requires driver to have had no arrests or convictions for driving while license revoked and be free from dependency or abuse of alcohol and drugs.

RELATING TO MOTOR VEHICLES.

Permits motor vehicle backup warning beepers to be disabled between 10:00 p.m. and 6:00 a.m. if the vehicle is guided by a person other than the driver of the vehicle while reversing.

RELATING TO HIGH OCCUPANCY VEHICLE LANES.

Increases fine for violating HOV lane law to $250 for 1st and all subsequent offenses.

RELATING TO TRAFFIC.

Requires department of transportation to perform a contraflow study of the Pali highway and report findings and recommendations to governor and legislature before 12/31/05.

RELATING TO BIKEWAYS.

Requires the department of transportation to build two-way bikeways on Queen Kaahumanu Highway and Waimea Bypass Road.

RELATING TO TRAFFIC.

Establishes the urban Honolulu regional traffic task force to identify major contributors to traffic congestion and make recommendations on traffic alleviation in areas bounded by Ward Avenue, Lunalilo H-1 Freeway, Kapahulu Avenue, Kalakaua Avenue, and Ala Moana Boulevard. Appropriates funds for the task force.

MAKING AN APPROPRIATION TO STUDY THE FEASIBILITY OF BUILDING A MOTOR VEHICLE AND RAILWAY TUNNEL UNDER HONOLULU HARBOR.

Appropriates funds to update study of the feasibility of building a tunnel under Honolulu harbor. Requires feasibility study to consider expansion of tunnel to include railway technology. Requires identification of available sources of federal funding. Appropriates funds.

RELATING TO LAND USE.

Authorizes each county to establish an advisory group to assist the county planning department to identify land use policies and development standards and to identify lands suitable for reclassification into the rural district. Requires office of planning to assist counties in coordinating meetings and provide technical assistance.

RELATING TO IMPORTANT AGRICULTURAL LANDS.

Establishes important agricultural lands (IAL) identification process. Requires an incentives study. Prohibits IAL designation without landowner petition until July 1, 2011. Provides an agricultural infrastructure improvement tax credit and IAL leasehold subdivisions. Makes identification of IAL contingent on enactment of legislative incentives. Makes appropriations.

RELATING TO NON-AGRICULTURAL PARK LANDS.

Establishes the Non-Agricultural Park Land Special Fund to pay for costs incurred in managing, administering, and overseeing non-agricultural park lands that are transferred, or in the process of being transferred, to the department of agriculture.

RELATING TO THE ALOHA TOWER COMPLEX

Requires the Aloha Tower Development Corporation to conduct a study to determine the feasibility of establishing a gathering place for visitors and residents at the Aloha Tower Marketplace.

Authorizes a county to impose the general excise tax.

RELATING TO ECONOMIC DEVELOPMENT.

Allows for the development or operation of observatories or related observational facilities within conservation land use districts to further the science or application of astronomy. Requires the Board of Land and Natural Resources to perform county by county assessments of areas with astronomy development potential.
