RELATING TO BOATING.

Requires an owner of a commercial vessel moored in a state small boat harbor to pay a fee of at least three percent of gross revenues derived from the use of the vessel; requires fees and penalties established through rules relating to harbors to be deposited into the Boating Special Fund.

RELATING TO POAMOHO TRAIL.

Preserves access to the Poamoho ridge trail by authorizing the department of land and natural resources to condemn the land for the trail and for the adjacent hunting area C access roads.

RELATING TO STATE PARKS.

Authorizes the use of moneys from the state parks special fund to pay debt service on revenue bonds issued for construction, repairs, replacement, additions, and extensions to parks facilities.

RELATING TO LAND USE.

Clarifies the process to appeal county land use decisions.

RELATING TO LATERAL PUBLIC ACCESS.

Establishes an additional requirement for county ordinances to require a subdivider or developer to provide public access from a public highway or public streets to also connect existing or proposed access points with each other, so the public can easily and safely traverse shoreline areas.

RELATING TO COASTAL ZONE MANAGEMENT.

Requires that shoreline setbacks be established at a distance inland from the shoreline equal to 50 times the annual erosion rate for the area, based on historic aerial photographs or the shoreline setback line established by the county, whichever is greater. Bans the construction of new seawalls and groins except where variances allowed for DOT.

RELATING TO PUBLIC ACCESS.

Prohibits gated communities that deny public access to any coastal shoreline or mountain or inland areas used for recreational or cultural purposes.

Requires owners of private roads to maintain private roads pursuant to agreement or in absence of agreement in equal shares.
