RELATING TO THE HAWAII COUNTY BOARD OF WATER SUPPLY.

Amends the number of members on the board of water supply and the method of appointment. Allows the vice-chairperson to execute contracts, documents of transfer, and vouchers for money disbursements. Allows the board to acquire property in its name.

RELATING TO STATE AND COUNTY TORT LIABILITY.

Repeals sunset date for public land liability immunity established by Act 190, SLH 1999, and sunset date for state and county tort liability relating to lifeguard services established by Act 170, SLH 2002.

Requires each county to enact zoning ordinances to protect against land slides and rock slides.

PROPOSING AN AMENDMENT TO ARTICLE XI, SECTION 1 OF THE HAWAII CONSTITUTION, TO REQUIRE USE AND PROTECTION OF HAWAII'S NATURAL RESOURCES IN A MANNER CONSISTENT WITH THEIR SUSTAINABILITY.

Proposing an amendment to article XI, section 1, of the Hawaii constitution, to require use and protection of Hawaii's natural resources in a manner consistent with their sustainability.

RELATING TO HAZARDOUS LAND.

Requires each county to identify hazardous land areas; adopt standards for building in hazardous land areas, and enact ordinances to implement standards.

RELATING TO COASTAL ZONE MANAGEMENT.

Clarifies the definition of "shoreline". Prohibits shoreline planting to establish the shoreline and for certification purposes. Authorizes the state land surveyor to rescind a shoreline certification based on a misrepresentation in the application.

RELATING TO PUBLIC ACCESS.

Allows the department of land and natural resources to enter into indemnity and defense agreements to protect landowners and persons associated with landowners to further the purposes of chapter 198D. Appropriates funds to conduct a metes and bounds survey and acquire a public right of way for a public access to the Ewa Forest Reserve and the Poamoho Trail.

RELATING TO IMPROVING WATER QUALITY.

Appropriates funds to develop and demonstrate comprehensive watershed management measures to improve water quality of Lake Wilson and reduce contaminated sediments in statewide waterways.

RELATING TO FLOOD CONTROL.

Appropriates $250,000 for fiscal year 2005-2006 and $500,000 for fiscal year 2006-2007 for the Center for Conservation and Research Training to develop and coordinate the implementations of watershed management strategies to control flooding in two of Hawaii's most severely flood-impacted watersheds as identified by the Center.

Allocates an unspecified percentage of the conveyance tax to the counties for the development of affordable housing.

Increases, from $25,000 to $40,000, the fine for each violation of the water pollution law, or any rule, permit, or variance issued under that law. Enacts provisions relating to muddy water. Allows citizen suits.
