RELATING TO AGRICULTURE.

Establishes an agricultural infrastructure improvement tax credit to promote agricultural diversity and increase agricultural self-sufficiency. (HB483 HD1)

RELATING TO DROUGHT MITIGATING FACILITIES.

Promotes the construction of drought mitigating water storage facilities by increasing the amount of the Drought Mitigating Water Storage Facilities Tax Credit to an unspecified percentage, repealing the date after which the Tax Credit is no longer available, and including costs for ancillary structures as qualifying costs for the Tax Credit. RELATING TO AGRICULTURE.

Exempts from processed food requirements and restrictions home-based agricultural producers of honey who sell less than 50 gallons of honey, sell directly to the consumer, and comply with labeling requirements. Effective date July 1, 2099. (HB1154 HD1)

RELATING TO STATE ENTERPRISE ZONES.

Establishes that agricultural businesses shall remain eligible for tax incentives under the EZ program in the event of force majeure; extends eligibility under the EZ program by the number of months of the force majeure's duration; allows agricultural businesses to meet annual gross revenue requirements if the businesses are unable to meet annual full-time employee requirements; includes leased employees and employees under a joint employer relationship in the definition of "full-time employee" for the EZ program. RELATING TO AGRICULTURAL THEFT.

Clarifies that possession of agricultural commodities removed from fenced or posted premises without an ownership and movement certificate is evidence that the person knows that agricultural commodities are or have been stolen in cases of theft in the second degree; clarifies that possession of livestock without a livestock ownership and movement certificate is evidence that the person knows the livestock is or has been stolen in cases of livestock theft; broadens the definition of theft in the second degree by including theft of agricultural commodities that weigh over 35lbs from fenced or posted premises. RELATING TO AGRICULTURAL TRESPASSING.

Provides that a person commits the crime of criminal trespass in the second degree if the person, without permission, enters cultivated or uncultivated agricultural land that is posted with signs forbidding trespass. (HB1202 HD2)
