Appropriates funds and authorizes implementation of a new port security system for the Port of Honolulu

RELATING TO INTOXICATING LIQUOR VIOLATIONS INVOLVING MINORS.

Requires judges to suspend the driver's licenses of licensed drivers under the age of 21 when the drivers have been convicted of illegal possession of liquor and if the defendant does not yet have driver's license, to postpone eligibility until the defendant is eighteen years of age or for ninety days, whichever period is longer. Allows a judge the discretion to permit limited driving for those with a suspended license for employment or educational purposes.

RELATING TO DRIVING UNDER THE INFLUENCE OF AN INTOXICANT.

Clarifies that the term of imprisonment for violation of section 291E-61(b)(4), HRS, shall not exceed the maximum term provided in subsections (b)(1), (b)(2), and (b)(3), respectively.

RELATING TO PHOTO TRAFFIC ENFORCEMENT

Authorizes the department of transportation to contract with a private vendor to assist with implementation of a photo red light imaging system to deter motorists who disregard red lights in counties with a population of over 500,000. Requires vendor to provide the State and counties with photographs of red light violators. Appropriates funds.

Authorizes the OIP to issue administrative fines against state or county agencies that do not comply with OIP opinions.

RELATING TO HIGHWAYS.

Creates a county highways task force within the department of transportation to oversee the transfer of all state highways functions and funding. Directs the task force to establish a timetable for the transfer of highway related functions and to review relevant highway related statutes and ordinances for possible revision.

Establishes the urban Honolulu regional traffic task force to identify major contributors to traffic congestion and make recommendations on traffic alleviation in areas bounded by Ward Avenue, Lunalilo H-1 Freeway, Kapahulu Avenue, Kalakaua Avenue, and Ala Moana Boulevard. Appropriates funds for the task force.

MAKING AN APPROPRIATION FOR THE "ROADS IN LIMBO" PROGRAM IN HAWAII COUNTY.

Appropriates $2,000,000 to maintain and repair roads in the "roads in limbo" program in Hawaii county.

RELATING TO PRIVATE ROAD MAINTENANCE

Requires owners of private roads to maintain their roads pursuant to agreement or in equal shares in absence of agreement.

RELATING TO THE SEARCH AND RESCUE REIMBURSEMENT ACT

Authorizes actions by the State and counties to recover the costs of search and rescue against a person whose failure to exercise reasonable care or failure to comply with the law or public safety warnings, necessitated the search and rescue.
