RELATING TO PRESCRIPTION DRUGS.

Requires quarterly reports from manufacturers of prescription drugs dispensed in the state that disclose the average wholesale price, wholesale acquisition cost, average manufacturer price, and best price for each of the manufacturer's drugs. Effective date July 1, 2099. (HB31 HD1)

RELATING TO PRESCRIPTION DRUG COST CONTAINMENT AND AFFORDABLE ACCESS.

Requires the Director of DHS to establish a Pharmacy Best Practices and Cost Control Program including medicaid and other state public assistance health benefits plans, in which any public and private health plan may participate. Includes a prescription drug preferred list and prior authorization review process. Requires drug manufacturers to disclose economic benefits of $25 or more provided to persons who prescribe, dispense, or purchase prescription drugs. Effective date July 1, 2099. (HB32 HD1)

RELATING TO ADMINISTRATIVE FINES UNDER THE STATE ETHICS CODE.

Authorizes the ethics commission to impose an administrative fine not to exceed $500 for a violation of the state ethics law.

RELATING TO FINANCIAL DISCLOSURE STATEMENTS.

Adds business interests and real property interests outside the State of Hawaii to the business interests and real property interests that must be disclosed under the financial disclosure law.

Changes the age from which persons may pre-register to vote from seventeen to sixteen years of age.

RELATING TO ELECTIONS.

Removes the requirement that the precinct chair be of the same political party as the governor.

RELATING TO ELECTRONIC VOTING.

Requires the generation of a paper ballot for the use of electronic voting systems. Authorizes reliance on electronic voting system vote tallies under certain conditions. Makes it election fraud to tamper with an electronic voting system to cause an inaccurate tally.

RELATING TO PRECINCT OFFICIALS.

Requires that the chairperson of the precinct officials be selected in the same manner as all other precinct officials and repeals the requirement that the chairperson be of the same political party as the governor.

RELATING TO ELECTIONS.

Adds a requirement that nonprofit organizations involved in polling not be a political action committee or political in nature. Makes it unlawful to use, print, publish, or distribute any voter registration information from affidavits or lists. Requires qualified political parties to submit names for precinct officials no later than the "40th" day, instead of the "60th day", before the close of filing for any election. Adds reciprocal beneficiary of a candidate to the list of those not eligible to serve as a precinct official in a candidate's precinct. Allows the watcher of a political party to be present at any time and to review the polling book but not to record confidential information.

Appropriates funds for the office of elections to meet the 5% matching fund requirement of the federal Help America Vote Act of 2002.

Clarifies that the confidential report by the Attorney General to the Legislature describing any advice given to its clients regarding corrective action to avoid future claims shall not be subject to publication and distribution requirements.

RELATING TO VICTIM RESTITUTION.

Mandates that defendants make restitution to victims. Removes judicial discretion. Provides that a defendant's financial ability to make restitution payments may be considered only in connection with establishing a restitution payment schedule.

RELATING TO THE COMMISSION ON THE STATUS OF WOMEN.

Requires that the 7 voting members of the commission on the status of women be appointed as follows: 3 by the governor, 2 by the president of the senate, and 2 by the speaker of the house of representatives.

RELATING TO IDENTIFICATION.

Provides for identification by means of DNA testing of all felons, and provides for less intrusive and more economical methods of testing. Requires DNA testing of each person arrested for a felony. Extends the statute of limitations in cases where DNA has been recovered as evidence. Provides for post-conviction DNA testing, and funding ($750,000) to implement the new DNA testing program.

Requires retention of evidence that can be used for DNA analysis. Establishes procedure for post-conviction requests for analysis of DNA evidence. Requires notice to victim of proceedings and outcome. Requires notice to probation and parole authorities of outcome adverse to defendant.
