RELATING TO CAMPAIGNS.

Establishes limits for campaign contributions to candidates, noncandidate committees, and political parties during specified election periods. Requires excess contributions to be returned to the original donor within thirty days of receipt of the donation, or the funds will escheat to the Hawaii election campaign fund. Limits contributions from nonresident individuals and entities to no more than thirty percent of the total contributions received by a candidate or candidate's committee in an election period. Defines "surplus funds" and "residual funds". Requires candidates for the Senate, House of Representatives, and the Office of Hawaiian Affairs to file campaign reports by electronic means beginning in 2006. Provides that a candidate does not have to file an organizational report if the candidate is seeking election to the same office in successive elections and does not have new information that must be updated in the report. Expands the public financing law and matches $2 for every $1 raised in excess of the minimum amount of qualifying campaign contributions needed to receive public funding. (HB1747 HD1)

RELATING TO TRAFFIC OFFENSES.

Repeals the penalties provided in section 291C-13, HRS, for violation of that section because penalties are already provided under section 291C-161, HRS. (HB438 HD1)

RELATING TO DRIVING UNDER THE INFLUENCE OF AN INTOXICANT.

Clarifies that the term of imprisonment for violation of section 291E-61(b)(4), HRS, shall not exceed the maximum term provided in subsections (b)(1), (b)(2), and (b)(3), respectively.

RELATING TO TRAFFIC OFFENSES REQUIRING IMPOSITION OF INCREASED PENALTIES FOR SUBSEQUENT OFFENSES.

Limits the time in which a prior conviction may be the basis for enhanced penalties for subsequent offenses as follows: Three years for offenses involving child restraints; one year for offenses involving violations relating to motor vehicle lights; and five years for offenses for motor vehicle alarms violations. RELATING TO USE OF INTOXICANTS.

Permits the forfeiture of a vehicle for conviction of operating a vehicle under the influence of an intoxicant within 5 years of 2 prior convictions or conviction of habitually operating a vehicle under the influence of an intoxicant, if vehicle is owned and operated by the driver. (SD1)

RELATING TO TRAFFIC OFFENSES.

Establishes the offense of excessive speeding, which is defined as 25 miles per hour or more over the speed limit or 80 miles per hour or more irrespective of the speed limit. (SD1)

RELATING TO DRIVER LICENSING.

Establishes a 3-stage graduated driver licensing program for persons under the age of 18. Requires licensee to be accompanied by a licensed parent or guardian when driving between 11 p.m. and 5 a.m., with limited exceptions. Requires instruction permit holders to be accompanied by a person who is at least 21, rather than 18, when driving. (SD1)

RELATING TO CELLULAR PHONES.

Bans the use of hand held cellular phones while driving. Allows for the use of hands-free cellular phones. Provides an affirmative defense for safety and medical emergencies. Provides a $200 fine. (HB88 HD2)
