RELATING TO ELECTIONS.

Adds a requirement that nonprofit organizations involved in polling not be a political action committee or political in nature. Makes it unlawful to use, print, publish, or distribute any voter registration information from affidavits or lists. Prohibits a reciprocal beneficiary of a candidate from serving as a precinct official in the precinct where votes are cast for the candidate. Allows the watcher of a political party to be present at any time and to review the polling book but not to record confidential information. (HB1712 HD1)

RELATING TO CAMPAIGN SPENDING.

Establishes a comprehensive public funding program for state legislative candidates and candidates for governor and lieutenant governor who agree to abide by campaign contribution and expenditure limits and meet other criteria. (HB1713 HD1)

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.

Authorizes the Office of Hawaiian Affairs (OHA) to make all necessary and appropriate disbursements of its moneys by issuing checks in its own name and by any other means. Authorizes OHA to deposit any of its moneys in a banking institution. Allows DAGS to continue to perform the payroll function for OHA. (HB447 HD1)

RELATING TO VICTIM RESTITUTION.

Mandates that defendants make restitution to victims. Removes judicial discretion. Provides that a defendant's financial ability to make restitution payments may be considered only in connection with establishing a restitution payment schedule. (HB278 HD1)

RELATING TO CAMPAIGNS.

Establishes limits for campaign contributions to candidates, noncandidate committees, and political parties during specified election periods. Requires excess contributions to be returned to the original donor within thirty days of receipt of the donation, or the funds will escheat to the Hawaii election campaign fund. Limits contributions from nonresident individuals and entities to no more than thirty percent of the total contributions received by a candidate or candidate's committee in an election period. Defines "surplus funds" and "residual funds". Requires candidates for the Senate, House of Representatives, and the Office of Hawaiian Affairs to file campaign reports by electronic means beginning in 2006. Provides that a candidate does not have to file an organizational report if the candidate is seeking election to the same office in successive elections and does not have new information that must be updated in the report. Expands the public financing law and matches $2 for every $1 raised in excess of the minimum amount of qualifying campaign contributions needed to receive public funding. (HB1747 HD1)

RELATING TO BIOLOGICAL EVIDENCE.

Requires DNA testing of all felons. Provides procedures and duties for the collection and testing of DNA samples. Establishes a procedure for expungement of DNA profiles for a person whose underlying conviction has been reversed. Extends the statute of limitations for felony cases where DNA evidence has been recovered. Requires retention of evidence that can be used for DNA analysis. Establishes procedure for post-conviction requests for analysis of DNA evidence. Requires notice to victim of proceedings and outcome. Requires notice to probation and parole authorities of outcome adverse to defendant. Appropriates $1 to implement the new provisions on DNA testing. (HB1733 HD2)
