RELATING TO LONG-TERM CARE

Creates demonstration project to reimburse at-home long-term family caregivers on Kauai from 2006-2009 to functionally dependent or cognitively impaired relatives. Appropriates $ for FY 2006-2007 and $ for FY 2008-2009. Requires DOH to report on project annually. Repealed on 6/30/2009.

RELATING TO FOSTER CARE HOMES.

Requires DHS to increase fees paid to foster care home providers by 7%.

RELATING TO CHILDREN.

Requires, rather than allows, the use of an ohana conference, which is to include a discussion of the feasibility of placing the child with a member of the child's extended family, for family decision making in the preparation of a service plan before placing a child in foster care.

RELATING TO THE CHILD PROTECTIVE ACT.

Protects child from being removed from a guardianship if parent cannot show substantial change in circumstances. Allows parent the opportunity to file for dissolution of a guardianship if it is shown that a safe home can be provided.

RELATING TO CHILD PROTECTIVE SERVICES.

Requires that the child protective review panel review proceedings taken prior to the issuance of a court order upon the request of the child's family who believe that the child was wrongfully removed from the family home.

RELATING TO CHILD SUPPORT ENFORCEMENT.

Provides the authority for the Child Support Enforcement Agency (CSEA) to provide services to non-custodial parents, allows disclosure of information in administrative proceedings, and the issuance of income withholding orders. Requires the non-custodial parent to keep the CSEA informed of medical insurance coverage. Enables the CSEA to notify employers of the requirement to provide medical insurance coverage by regular mail or transmission by electronic means.

RELATING TO FAMILY COURT.

Redefines joint custody as shared parenting or equal parenting time as developed in a parenting plan. Creates a rebuttable presumption in favor of shared parenting in all custody actions involving children.

RELATING TO PUBLIC SAFETY.

Establishes a task force to develop programs and support services for children of incarcerated parents, as well as programs to strengthen the family bond. Requires the Department of Public Safety to implement the task force's recommendations. (HD1)

RELATING TO THE COUNTIES.

Establishes that counties shall not require neighborhood board approval of a church/nonprofit corporation operated after school program when considering the program for zoning or permitting approval.
