RELATING TO TOBACCO.

Requires businesses engaged in the sale of cigarettes and other tobacco products at the retail level to acquire a retail tobacco permit from the Department of Taxation. Provides criminal penalties for the retail sale of cigarettes or other tobacco products without a valid retail tobacco permit, and for the seizure and for forfeiture of cigarettes and other tobacco products sold, possessed, dept, acquired, distributed, or transported without a valid retail tobacco permit.

RELATING TO CIGARETTE TAX.

Increases tax per cigarette to $ , $ , and $ on 9/30/2005, 6/30/2006, and 6/30/2007, respectively (amounting to $ , $ , and $ per pack of 20 cigarettes). Earmarks    %,    %, and    % of tax for general fund, DOH health promotion programs, and smoking cessation programs, respectively.

RELATING TO SMOKING.

Bans smoking in all areas of airports and hospitals.

RELATING TO TRANSFERS FROM SPECIAL FUNDS FOR CENTRAL SERVICE EXPENSES.

Exempts the tobacco settlement fund from department of accounting and general resources charges for central services and administrative expenses.

MAKING AN APPROPRIATION FOR EMERGENCY SOCIAL WORK AND SUBSTANCE ABUSE INTERVENTION.

Appropriates $    and $     to DOH and DHS, respectively, to fund emergency intervention by substance abuse employees and social workers for ice-affected families on a 24-hour basis, 7 days a week.

RELATING TO MENTAL HEALTH.

Allows parents or guardians to admit individuals under the eighteen to nonemergency psychiatric treatment facilities without the consent or countersignature of the individual.

RELATING TO THE PHYSICAL ACTIVITY AND NUTRITION COALITION TASK FORCE.

Establishes the physical activity and nutrition coalition task force for the State.

RELATING TO TRADITIONAL HAWAIIAN HEALING PRACTICES.

Changes "panel" to "kupuna council" in relation to regulating traditional native Hawaii healing practices. Makes the kupuna council independent from the State and authorizes any individual regardless of race or ethnic origin to be certified by the kupuna council as a traditional Hawaiian healer.

RELATING TO DOMESTIC VIOLENCE FATALITY REVIEW.

Authorizes the director of health to establish domestic violence fatality review teams to review domestic violence fatalities.
