Incorporates the concepts of sustainable development and self-sustainability into the Hawaii State Planning Act.

RELATING TO AGRICULTURAL INSPECTIONS.

Allows the Department of Agriculture to establish rules that require identification of specific articles on bills of lading for the purpose of inspection due to pest risk.

RELATING TO INVASIVE SPECIES.

Allows private and public landowners to remove noxious trees within a conservation district by applying for a site plan approval permit with the DLNR; exempts this activity from the requirements of chapter 343 where DLNR determines that there is no significant effect on the environment.

RELATING TO THE DEPARTMENT OF AGRICULTURE.

Authorizes the department of agriculture to charge user fees for the inspection and other invasive species prevention services provided by the department under chapter 150A, HRS. Also establishes an invasive species special fund.

RELATING TO SEAWATER AIR CONDITIONING.

Creates a streamlined application and review process for the development of seawater air conditioning (SWAC) district cooling systems.

RELATING TO THE SEAWATER AIR CONDITIONING.

Exempts seawater air conditioning district cooling systems from PUC regulation, provided that at least fifty per cent of the energy required for the system is provided by a renewable energy source.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST SEAWATER AIR CONDITIONING PROJECTS ON THE ISLAND OF OAHU.

Authorizes issuance of special purpose revenue bonds to Honolulu Seawater Air Conditioning LLC for the purpose of design and construction of the chilled water distribution system and balance-of-system components and structures of a district cooling system in downtown Honolulu.

RELATING TO COASTAL LIGHT POLLUTION.

Authorizes the prohibition of artificial lights that are positioned toward and directly illuminate the ocean, unless such light is authorized and required for public safety or safe ocean navigation. Prohibits floodlights, uplights, or spotlights for decorative and accent purposes that are directly visible from the beach.

Prohibits the growing of pharmaceutical crops using genetically engineered techniques.

RELATING TO GENETIC ENGINEERING.

Requires a biotech company that sells a genetically engineered organism to provide written disclose of possible risks from the use of such an organism; written notice does not waive any liability a biotech company may have toward a purchaser.

Prohibits the planting of a genetically engineered seed or plant part in an open field; allows the chairperson of the board of agriculture to grant an exception where such planting is done in a controlled environment.

Prohibits an entity selling seeds from representing that the product sold is free of genetically engineered material if that entity knows or should know otherwise, or if the director of the department of agriculture discovers genetically engineered material.

Provides for strict liability for injuries caused by the release of genetically engineered organisms from plant sources.
